2.1 Service Tiers

BrainSpeed offers different subscription tiers to accommodate various user needs:

• Starter: 2,000 new exercises per month, up to 20MB file uploads, storage for up to 30 documents, and 500,000 AI chat tokens monthly
• Personal: 10,000 new exercises per month, up to 50MB file uploads, storage for up to 75 documents, and 1,000,000 AI chat tokens monthly
• Ultimate: 25,000 new exercises per month, up to 100MB file uploads, storage for up to 400 documents, and 3,000,000 AI chat tokens monthly

2.2 Exercises

An exercise refers to any individual learning item generated by the platform, including flashcards, multiple-choice questions, or any other type of study question. Each time the system generates a new flashcard or question, it counts as one exercise towards your monthly limit. The exercise limit resets at the beginning of each billing cycle.

2.3 Document Storage

Document storage limits apply to both user-uploaded files and automatically generated documents. This includes:

• Files uploaded directly by users (such as PDFs, PPTXs)
• Automatically generated PDFs from website URLs or other sources

2.4 AI Chat Tokens

AI chat tokens are units of text that the AI processes during interactions with BrainSpeed AI. These tokens are consumed whenever you engage with the AI to ask questions, clarify details, or discuss documents. Each subscription tier includes a monthly allocation of tokens, and usage is reset at the beginning of each billing cycle.

3.1 Subscription Billing

• Subscriptions are billed on a recurring basis, either monthly or annually(if available), depending on the plan you select at the time of purchase.
• Payments will be automatically charged to your chosen payment method on the first day of each billing cycle.
• By providing your payment information, you authorize BrainSpeed (via Stripe) to charge the applicable subscription fees for your selected plan on a recurring basis until you cancel your subscription.

3.2 Payment Methods

• BrainSpeed accepts payment via credit or debit cards processed through Stripe. You are responsible for ensuring that your payment details are accurate and up to date.
• If your payment method fails or is declined, you will receive a notification and will have the opportunity to update your payment information. If payment is not received within a reasonable timeframe, your access to the platform may be limited or suspended until the outstanding balance is settled.

3.3 Payment Changes and Plan Upgrades/Downgrades

• You may upgrade or downgrade your subscription plan at any time. When upgrading to a higher plan, the new plan's fees will be applied immediately, and the difference will be prorated. When downgrading, the new plan will take effect at the start of the next billing cycle.
• Any changes to your payment method or subscription plan can be managed in your account settings.

3.4 Subscription Renewal and Cancellation

• Subscriptions will automatically renew at the end of each billing period unless canceled prior to the renewal date. You can cancel your subscription at any time through your account dashboard.
• If you cancel your subscription, you will retain access to the paid features until the end of the current billing cycle. After that, your account may be downgraded to a free version of the platform, if available, with limited features and storage. If a free version is not available at that time, access to your account may be blocked, and BrainSpeed reserves the right to delete or restrict access to any stored documents or data.
• In cases where the account is downgraded to a free version but exceeds the free plan's limits, BrainSpeed reserves the right to restrict access to stored documents or block access to the account.

3.5 Failed Payments and Account Downgrade

If payment is declined or fails for any reason, BrainSpeed will attempt to charge your payment method again. If the issue persists, your account may be downgraded to the free version of the platform with usage restrictions. BrainSpeed reserves the right to limit your access to stored documents and features until payment is resolved. Prolonged non-payment may result in the deletion of stored documents that exceed the free plan's limits. If a free version is not available at that time, access to your account may be blocked, and BrainSpeed reserves the right to delete or restrict access to any stored documents or data.

3.6 Pricing Changes

BrainSpeed reserves the right to modify its pricing at any time. Any changes in pricing will be communicated to existing subscribers in advance, and new pricing will take effect at the next billing cycle. If you do not agree to the new pricing, you may cancel your subscription before the new pricing takes effect.

3.7 Refunds

All subscription payments are non-refundable, as outlined in our Refund Policy. Exceptions may be made for technical issues or billing errors as determined by BrainSpeed's discretion.

In the event that a payment is refused, canceled, or fails, your account may be downgraded to a free or restricted version of the platform. BrainSpeed reserves the right to limit access to features and reduce storage capacity, which may result in the deletion of stored documents or created study sessions if they exceed the free plan's limits. To avoid data loss, users are responsible for maintaining an active subscription or downloading their content prior to subscription changes.

BrainSpeed offers a subscription-based service, and all payments are non-refundable once processed, except where required by applicable law. By subscribing to any of the paid plans, you agree that all fees are final, and BrainSpeed is not obligated to issue refunds for unused services, whether in full or in part, including in cases where you decide to cancel your subscription before the end of the billing period.

Refunds may be considered only under the following circumstances:

• Technical Issues: If you are unable to access the platform or use its core features due to a technical fault caused by BrainSpeed, you may be eligible for a partial or full refund for the affected period, subject to BrainSpeed's assessment.
• Incorrect Billing: If there is an error in billing, such as being charged for an incorrect plan or an unauthorized transaction, BrainSpeed will correct the error and issue a refund if appropriate.

Requests for refunds must be submitted to our support team within 14 days of the transaction date. Refunds will be issued at BrainSpeed's sole discretion and only in cases where there is a clear error or failure in service.

No refunds will be issued for:

• Changes in your usage, preferences, or decisions to stop using the platform before the billing cycle ends.
• Failure to cancel the subscription before renewal. Users are responsible for managing their subscription and can cancel at any time to avoid future charges.

For any disputes or concerns regarding payments, you may contact us at refund@brainspeed.ai. BrainSpeed will review refund requests on a case-by-case basis and provide a response within a reasonable time.

BrainSpeed is not liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of data, revenue, or profits, whether in an action of contract, negligence, or other tort, arising out of or in connection with your use or inability to use the platform.

While BrainSpeed makes every effort to deliver accurate, reliable, and high-quality content:

• The platform may not always meet your specific requirements or expectations.
• The platform may experience interruptions, delays, or errors that affect its performance.
• The results or content generated by the platform, while designed to be helpful, may not always be completely accurate or suitable for your educational, professional, or personal use.
• Errors or defects in the platform may occur, and while we strive to correct them promptly, we cannot guarantee they will be resolved immediately.

You acknowledge that BrainSpeed uses advanced AI-based algorithms to generate content, and although we aim for high accuracy and relevance, the results may not always be error-free. Users are encouraged to review and verify the accuracy and appropriateness of the content generated by BrainSpeed before relying on it for any academic, professional, or personal decisions.

BrainSpeed takes all reasonable steps to improve and maintain the quality of its services, but we cannot accept responsibility for any reliance on or use of the content provided by the platform, including but not limited to any learning materials, study sessions, quizzes, or flashcards. The platform is intended to serve as an aid to learning, and users should exercise their own judgment and discretion when applying the content generated by BrainSpeed.
